There are times when the lenders go beyond any limits in order to get back their debts and they start harassing the debtor for this purpose. The most annoying thing that the debt collectors usually do is that they keep on calling the debtors and asking them to pay back their debt. Then they also start using abusive language and harass the debtors in this way. Some of them also threaten the debtors that if they do not pay back the money then they will use violence to get it back. Then there are also the debt collection agencies which functions on behalf of the debt collectors and most of these agencies were said to act on violent means in order to get back the debt. What these agencies used to do was that they used to buy some of the debts from the debt collectors depending upon the value of the debt and then after that they used to harass the debtors as they asked for the whole amount from the debtors even though they bought only a part of the debt and they also threatened to take recourse to unfair means if they do not pay back the debt. Moreover, they also went against the statute of limitations in which it is clearly stated that the debt collectors cannot ask to pay back the money if the time period for asking the money has passed.
Thus, taking into account all these problems the Fair Debt Collection Practices Act was passed which safeguarded all the rights of the debtors. According to the act, the debtor is supposed to give prior notice to the debtor in which the amount and the time period for repayment should be mentioned. Then they are not allowed to use abusive language or harm the debtor in any way. They cannot ask for the debt after the time period has expired. Moreover, the act also states that if the debtors face any sort of trouble with their debt collector they can lodge the complaint in their state attorney general's office and their problems will be taken care of.
Thus, these are the debt collection harassment practices that are practiced by the debt collectors and to keep a check on them the debt collection harassment law is also introduced.
